Please read these Terms carefully before using the Hayah platform. By creating an account or accessing hayah.africa you agree to be bound by these terms.
By accessing or using the Hayah platform (hayah.africa, including any mobile applications), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the platform.
We may update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. We will notify registered users of material changes by email or in-platform notification.
You must be at least 18 years of age to create an account and use Hayah. By registering, you represent that you meet this requirement.
Providers must complete identity and document verification before they can accept bookings. Hayah reserves the right to decline or suspend accounts at its discretion.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at security@hayah.africa if you suspect unauthorised access.
Each person may hold only one account. Creating multiple accounts to circumvent a suspension or to manipulate the platform is prohibited.
You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
Hayah is a marketplace that connects clients with service providers. We facilitate the discovery, quoting, booking, and payment process but we are not a party to any service agreement formed between a client and a provider.
Hayah does not employ service providers. Providers are independent contractors. Hayah makes no warranty regarding the quality, safety, legality, or fitness for purpose of any service listed on the platform.
Clients are responsible for accurately describing their project requirements. Providers are responsible for delivering the services they agree to provide.
Hayah uses an escrow mechanism for certain booking types. When a client funds escrow, payment is held by Hayah until the client confirms completion or a milestone is approved.
Service fees are charged to clients and/or providers as disclosed at the time of booking. Fee schedules are published on the platform and may change with 14 days' notice.
Disputes over payment release are handled by Hayah's support team. Hayah's decision in a mediated dispute is final and binding.
Chargebacks filed with a payment provider outside of Hayah's dispute process may result in account suspension.
You may not use Hayah to engage in any unlawful activity, to defraud other users, to post false or misleading information, or to harass or threaten any person.
You may not attempt to circumvent the platform by taking work or payments off-platform in a manner intended to avoid Hayah's fees or protections.
You may not scrape, copy, reverse-engineer, or distribute any part of the Hayah platform without prior written consent.
Violations may result in immediate account suspension and, where applicable, referral to relevant authorities.
You retain ownership of content you upload to Hayah (portfolio images, job descriptions, messages, etc.). By uploading content, you grant Hayah a non-exclusive, worldwide, royalty-free licence to display and distribute that content as necessary to operate the platform.
You are solely responsible for your content. Hayah does not pre-screen user content but reserves the right to remove any content that violates these Terms or that we consider harmful, offensive, or misleading.
All platform software, design, trademarks, and original content created by Hayah are owned by Pawuricloud Private Limited. Nothing in these Terms grants you any right to use Hayah's intellectual property without express written permission.
To the maximum extent permitted by applicable law, Hayah, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any services procured through it.
Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount of fees you paid to Hayah in the three months preceding the claim.
You may close your account at any time by contacting support@hayah.africa. Closure does not affect any outstanding bookings or pending payments.
Hayah may suspend or terminate your account immediately if you breach these Terms, if required by law, or if we determine that your continued use poses a risk to other users or the platform.
These Terms are governed by the laws of Zimbabwe. Any disputes shall be resolved in the courts of Zimbabwe unless otherwise agreed in writing.
